Alina Habba leaves her post after judicial disqualifies her service.
The former personal attorney for Donald Trump has resigned as the US Attorney for New Jersey. This follows a legal ruling that challenged her eligibility to hold the office.
Acceptance of Resignation
The nation's top law enforcement official, the Attorney General, confirmed the prosecutor's departure on the start of the week. In a statement that the appeals court finding made it unworkable for the official to effectively run her office.
"Let no one confuse compliance for surrender," Habba stated. "My fight will now extend throughout America."
Judicial Challenge
Habba's exit comes a week after a federal appellate panel determined that she had been unlawfully serving as the top prosecutor. This judgment is expected to impact numerous legal proceedings in the state.
The appellate judges said that a temporary posting that bypassed the advice and consent of the Senate breached the Federal Vacancies Reform Act.
Future Role and Reaction
It was also stated that she will stay on at the Department of Justice as a high-level advisor. Habba plans to seek further review of the ruling, in the hope of achieving a reversal.
Writing online, the Attorney General contended that judges "cannot be permitted to override the appointment of lawyers tasked with carrying out the fundamental role of the presidency of prosecuting crime."

Bondi highlighted her tenure and noted that while she was in charge, the city of Newark saw a one-fifth decrease in criminal activity. She also stated that the Camden recorded its initial homicide-free summer since 1974 without a homicide.
Background and Previous Role
Habba, 41, originally became part of Trump's personal legal team in 2021. She later represented Trump in his business records case in the previous year, which resulted in his conviction on multiple felony counts of document fraud.
Prior to Habba took on the federal prosecutor position, Donald Trump had revealed he was selecting her as his presidential counsellor if re-elected, calling Habba as a steadfast ally and a "tireless advocate for justice".
